Police Commission Solicitor Wants Proof of Bias Against Pennsburg

                One Pennsburg representative on the Upper Perk Police Commission shut down a request by it's the commission's solicitor to discuss his alleged prejudice against the borough.

                During the old business portion of Monday's monthly police commission meeting, Solicitor Phil Gazan asked Kristopher Kirkwood to present any evidence, related to issues of privilege, it might have "so we can settle this."

                Initially, Kirkwood said Gazan was not entitled to the information.

                "The issue is closed," said Kirkwood, the president of Pennsburg Borough Council. "That's all you are going to get."

                Specifically, Gazan asked for Kirkwood to provide evidence supporting seven claims that the solicitor displayed a bias for East Greenville.

                "You are not entitled to get them," Kirkwood said. "Our (borough) solicitor has advised us to say this issue is closed. Besides, all the information is public."

                In April, Kirkwood publically identified seven allegations of bias against his municipality.  They included Gazan failing to properly share information with officials from Pennsburg in the present and the past, billing the commission for issues related to an anonymous police donation last year for five months after the issue was concluded, allowing insurance issues to drag on longer than necessary, failing to make sure insurance carriers adhered to their contractual obligations, billing Pennsburg officials for asking questions about billing issues, relying on Chief Michael Devlin to answer questions asked of him in regards to personnel manners and procedures and representing East Greenville Mayor Ryan Sloyer, a police commission member, in a bankruptcy procedure.

                In June, Sloyer's father in-law confirmed that Gazan represented Ryan Sloyer's wife in civil case initially filed Dec. 31, 2008. According to John Mansfield, the lawyer defended Aricia Sloyer in the Montgomery County Court of Common Pleas against a credit card company, listed on the county website as Capital One Bank USA NA trying to collect money from her over a card she never possessed.

                Mansfield said his daughter won the case. An award of arbitration findings for Aricia Sloyer, listed as the defendant, was mailed by the court on May 20, 2010, according to the same website.

                During the same meeting, Pennsburg's three commission members attempted, unsuccessfully, to fire Gazan as the solicitor.

                Sloyer did not attend the most recent meeting, hosted by East Greenville.

                On Monday, the solicitor chided Kirkwood for failing to deal with the issue in a more professional manner.

                 "As the solicitor for a number of years, I expected more from you as a member of this commission," Gazan said during the meeting. "You have made these statements in public and had them published in the newspaper, and have not provided any documentation that I am prejudiced against Pennsburg."

                 Asked by Marita Thomson, an East Greenville representative on the commission, if Kirkwood considered the matter settled, the Pennsburg borough council member said he reserved the right to broach the subject at his discretion.

                "So is this issue dead?" Thomson said.

                "I wouldn't say that," Kirkwood said. "I'm going to bring it up if he does something wrong."

                 Joseph Adam, a sergeant with the Upper Perk Police District, told the commission that the department responded to 15 incidents in Pennsburg and 13 incidents in East Greenville during June.

                  They included eight incidents of assault/harassment/stalking, five incidents of theft/motor vehicle theft, three incidents of public drunkenness/disorderly conduct and two incidents each of driving under the influence, burglary/attempted burglary and violations of borough ordinances and other offenses.
