Upper Perk Police said an East Greenville man who was barred from contact with a woman after admitting to assaulting her in November and allegedly threatening her in February, tried to strangle her Saturday.
Herbert Boyer, 51, was arrested for simple assault, harassment and unlawful restraint, all misdemeanors, after an incident around 7:28 a.m. at his home in the 400 block of Blaker Drive. He remains incarcerated in Montgomery County Correctional Facility.
During the altercation, police said a neighbor heard Boyer and the woman yelling and then said the woman was being thrown into a window. The woman reportedly ran outside the home and was screaming for help, according to authorities.
Upon arrival, police said the woman had visible injuries to her back and both arms. She told authorities Boyer threw her to the ground and attempted to strangle her, using both hands. While she was on the floor, she said Boyer was on top of her and wouldn't let her get up, according to court papers.
The woman was transported to St. Luke's Hospital for treatment by Upper Perkiomen Ambulance. Police said Boyer was arrested without incident.
Court records show Boyer was arrested Nov. 25, 2015 after an argument with the woman turned physical. During that incident, police said the couple argued over Boyer allegedly taking the woman's medication and money. Boyer then reportedly strangled the woman after grabbing her by the throat and punched her in the head.
According to Montgomery County Court personnel, Boyer pleaded guilty to one count of simple assault March 28 and was sentenced to one year of probation by Judge Thomas P. Rogers of Montgomery County Court of Common Pleas. All other charges were dropped as part of the plea agreement and Boyer was ordered to avoid "offensive contact" with the victim.
Boyer was also arrested Feb. 4 after he allegedly threatened the same woman with a hammer, telling her he'd kill her, and kicked in a bathroom door at the home, according to a criminal complaint in that case.
After his latest arrest, Boyer was remanded to jail on $20,000 cash bail, set by Judge Patricia Zaffrano of Bala Cynwood District Court. He is expected in court May 10 in Red Hill for preliminary hearings for both the terroristic threat and assault cases in front of Judge Catherine Hummel Fried.
