Man Charged with Assaulting Douglass Twp. Police Officer
The Earl Township man who allegedly dragged a Douglass Township police officer 15 feet in a convenience store fueling area last month faces eight felony, 74 misdemeanor and one summary count from two recent incidents.
Paul H Fackler III, who was taken into custody seven days later, faces a Sept. 14 preliminary hearing at 11:15 a.m. before District Judge Maurice Saylor, according to information posted on the Unified Judicial System of Pennsylvania Web Portal.
Fackler, 31, of the 100 block of Blackberry Road, fled the scene of the WAWA, located at the intersection of Route 100 and Grosser Road, following an Aug. 13 incident in which he drug Officer Andrew Poux 15 feet on the store's lot, according to the affidavit of probable cause.
One week later, township Constable Joshua Stouch took Fackler into custody. Stouch found the suspect sleeping inside a home in the 100 block of Chestnut Street in Pottstown following a two-day manhunt.
Douglass Township police previously charged Fackler with multiple drug-related charges following a May 2 traffic stop on Route 100 in the vicinity of County Line Road. A muffler tip falling off the vehicle driven by Fackler led to the stop, according to the affidavit of probable cause field in Saylor's court.
It states that the officer smelled a strong odor of marijuana coming from inside the car. Fackler stated he could "get the weed out of the center console, however he did not want police to search the remaining area of the vehicle."
A legal search of the vehicle turned up a small amount of marijuana, crystal methamphetamine, 30 mg. of Oxycodone, a black digital scale with marijuana residue and a variety of drug residue, according to authorities.
Police charged Fackler with a felony charge of possession with and intent to manufacture or deliver, 55 misdemeanor counts of possession of drug paraphernalia, three misdemeanor counts of possession of a controlled substance, two misdemeanor counts of marijuana possession and a summary charge for failure to remove inoperable equipment.
Three months later, at the convenience store at 1111 Grosser Road in Douglass Township, a woman approached two officers and told them her boyfriend had made a comment about hurting himself and asked if he could be involuntarily committed to a mental hospital, according to court records.
It states that the woman told them her boyfriend was outside by the gas pumps. A search of a Berks County database turned up a criminal arrest warrant for Fackler, the woman's boyfriend.
Fackler, who climbed into the driver's side seat of his car as the officers spoke to the woman, ignored numerous commands to turn off the engine and exit the vehicle. Instead, he put the car in gear, according to the document.
It states that Poux attempted to turn off the car. Fackler revved the engine and sped off, dragging the officer 15 feet as the vehicle accelerated.
Poux, who suffered multiple abrasions and contusions to both of his arms, became dislodged from the vehicle and rolled across the parking lot, according to court papers. The officers chased the car, which exited the store at a high speed heading north on Route 100.
On Aug. 21, authorities charged Fackler with seven felonies for aggravated assault and flight to avoid apprehension and 14 misdemeanors for reckless endangerment, simple assault, harassment, criminal mischief and disorderly conduct.
Fackler has been remanded to Montgomery County prison after failing to post bail which has been set at $100,000, according to information posted on the judicial web portal. It also states that he has submitted a request for a public defender.
